In a recent post on mediate.com., Joy Rosenthal, mediator and litigator, opined that the most important role of the mediator is to get each party understand the other party’s point of view. While it may be somewhat tenuous to try to label the absolute most important role of the mediator, there is no question that the statement made by Attorney Rosenthal has ample justification. You have little chance of getting to a meeting of the minds in a dispute, if the parties have little regard for what motivated the opposing party to act and argue as they have done. The ability to understand the other party’s position is also an important method of attaining empathy. (See next post). There is a great deal of wisdom in the quote by Carl Jung: “It all depends on how we look at things, and not how they are in themselves.”

Mediate don’t litigate.
