The Benefits of Mediation/Martin Rosenfeld, JD

Many benefits are listed as “selling points” for mediation. It is fast, it is relatively inexpensive, it is private, etc. However, there are benefits of mediation that go beyond its favorable comparison with standard litigation. It is better to resolve disputes amicably than via confrontation and rancor. Tf you will, mediation is better for the soul.

The Swiss psychiatrist Carl Jung made a very telling statement that applies to the mediation model:
“The most intense conflicts, if overcome, leave behind a sense of security and calm that is not easily disturbed.”

We all desire calm in our lives. No one will juxtapose the terms “calm” and “litigation”. Litigation is a process once aptly described by journalist Ambrose Bierce. Mr. Bierce compared litigation with the converting of a pig into sausage. Ever been in litigation? This is not far from the truth. Want a life of calm? Try to aim for Win-in in your disputed matters in life. In other words, mediate don’t litigate. It will bring you closer to a life of security and calm.
