Julian Zelizer, writing recently for described how President Trump deals with many of his favorite issues. He dehumanizes his “opponent”; he generates fear; and he then describes the action he proposes to take. (Think e.g. immigation issue.)This script leaves behind a legacy of mistrust and division. Does it sound familiar? In contested matters such as divorce, parties often resort to these same tactics. Litigation will rarely bring the parties to civil discourse or to Win-Win. If winning at all costs is the desired outcome, mediation may not be needed or even helpful. Do you really prefer mistrust over civility? Is winning at all costs what you truly stand for. Are you a Trumpian by nature? Mediate don’t litigate.
