(The following information comes from an article entitled “Why We Need Fewer Lawyers” by Professor Jonathan H. Adler, at WSJ/9/7/17)).PayPal and eBay currently utilize computer-assisted mediation. The companies employ systems that can identify areas of agreement between vendors and purchasers and they then propose potential solutions. Approximately 90% of assigned disputes are able to reach a resolution. This allows mediators the luxury of spending their time on more complex disputes.

What does this tell us? Mediation is here to stay. Computers can be programmed to conduct mediation because the range of options for resolution are both predictable and foreseeable. Computers are trying to tell us something; i.e. mediate don’t litigate. Even a non-animate object (i.e. computers) knows that.
