Remember Mark Sanford?/Martin Rosenfeld, JD

Mark Sanford, a former South Carolina Governor, and now US Representative, has agreed to enter into mediation for divorce-related issues with his ex-wife, Jenny. Mr. Sanford took off from his Governor duties, years ago, to meet with his then paramour. The divorce was messy and public. While the idea of mediation is always a good one, it is noteworthy that the divorce had been granted four years ago. This means that the past four years, filled with enmity and screaming headlines, hurt the Sanford children, and family members, with no positive outcome. It was all Lose-Lose. It is never too late to make the right decision but it is also hard to put the genie back in the bottle so many years later. Think carefully about mediation when the time comes. You may still get other chances to mediate later, but at what price. It is difficult to rationalize four years of pain and embarrassment. Mediate don’t litigate.
